Road Hazards Big Problem for Motorcyclists

A man who was injured when the motorcycle he was riding on hit a drain created by a local road paving company is suing that company. The lawsuit was filed in a West Virginia Circuit Court against Mountaineer Contractors, Inc. According to the suit, the contracting company had paved several roads in Morgantown, West Virginia, and as part of the paving project, certain drain openings were placed in the pavement "at significant depth below the surface of the roadway, creating a hazard to persons using the roadway," according to the lawsuit.

Daniel Slonaker was riding his motorcycle in July 2005 when his front wheel entered the hole surrounding the drain left by the paving company. Slonaker was thrown over the handlebars of the bike and hit his head on the pavement. He sustained several injuries, including a closed head injury, which resulted in loss of memory and mental impairment. The suit alleges it is the paving company's fault because the hole and the drain were not marked.

Denver Airplane Disaster

More details are emerging in the Boeing 737 airliner that crashed during takeoff Saturday at Denver International Airport (DIA). The jet was on its way to Houston after having engine trouble that supposedly had been fixed. At just around 6:18 p.m. Saturday evening, passengers felt the plane veer to the left and then felt some bumpiness that many passengers thought was just some turbulence. Then, many passengers noticed a giant fireball. The plane skidded off the runway with its wheels disintegrating and slid into a ravine. Passengers tried to get out of the plane, and the scene was described as chaotic by many of the people on board.

One passenger, Gabriel Trejos, noticed the escape chute in the middle of the plane and made a mad dash for that, with his baby in his arms. Out of the 115 people aboard the 737, 40 were injured, two critically, according to early reports. The cause of the airplane accident in Denver has not yet been determined at the time of this writing.

West Virginia Doctor Discovered to Have 120 Malpractice Cases Pending

An osteopathic physician who lied on his application for a position at Putnam General Hospital (Putnam County, WV) five years ago, has over 120 medical malpractice lawsuits pending against him at the current time.

Dr. John A. King, originally from Alabama, had gaps in his application, has been arrested, has left other positions abruptly, and has over 120 malpractice lawsuits pending in the United States. Somehow, all these red flags went unnoticed to the Putnam General Hospital and he was hired as an orthopedic surgeon in October 2002.

An attorney for the hospital insists that the hospital properly followed a seven-step screening process before granting King temporary credentials. Hospital officials say they found that King was licensed and in good standing in nine other states, that he was insured and that former colleagues and instructors gave him great reviews. Hospital officials state that several other hospitals where King performed surgeries did not report malpractice claims to the national database that hospitals rely on when interviewing candidates.

King surrendered his medical license and has since left the state.

Organ Recipients Die After Transplants

In a different sort of medical malpractice case in Indiana recently, two complaints were filed against the Indiana Organ Procurement Organization after skin cancer was spread to two recipients from one donor. One man received a liver and a kidney and another man received the other kidney; both died nearly a year after the transplant. The complaint alleges that the organ procurement group did not adequately screen donated organs. The Indiana Organ Procurement Organization is defending its actions and is stating it followed all state and federal regulations.

The United Network for Organ Sharing, which oversees organ procurement and transplantation in the U.S., has guidelines to help ensure donor organs are healthy. The guidelines dictate medical tests and examinations that should be performed before an organ is accepted for transplants.

Accutane and Bowel Disease

In the past, we have blogged about the dangerous acne drug, Accutane, and how it has caused Inflammatory Bowel Disease in some of the people taking the drug. An eight-person jury in Atlantic, New Jersey recently found that the maker of Accutane, Hoffman-La Roche failed to provide adequate warning of the possible adverse side effects of the drug. The jury awarded damages totaling $12.89 million to be apportioned among the three plaintiffs, now in their mid-to-late twenties. They were teenagers when they took Accutane to fight acne.

The jury deliberated just four hours before awarding the three the large settlement. The verdict capped a five-week trial in New Jersey State Superior Court. The three plaintiffs were all from Florida, and all were prescribed Accutane nearly ten years ago while still in their teens. All three suffer with IBD at various stages. One plaintiff will soon be having his colon surgically removed, and two plaintiffs will be on medication for the rest of their lives.

Medical Error Caused Stroke

A Madison County, Illinois hospital, Saint Anthony's Health Center, and several of its doctors, are facing a ten-count medical malpractice suit after Joyce Cooper claims she suffered a stroke as a result of their negligence. The claim states that Cooper's family physician sent her to St. Anthony's emergency room where a cardiac catheterization was performed. Cooper claims that during the catheterization, doctors could not engage the left coronary artery despite several attempts. After Cooper awoke from the procedure, she began having vision problems and problems focusing; she was ultimately diagnosed with a stroke.

Cooper's claim alleges the defendants negligently performed the catheterization, failed to properly utilize the left coronary artery, failed to prevent a brain infarction, and performed the test when it was not necessary for her treatment. Cooper is seeking damages in excess of $500,000 plus costs and attorneys fees.

LASIK Surgery Leaves Man With Eye Damage

A West Virginia man was recently awarded over $1 million dollars by a jury due to botched eye surgery. Dr. Mark Whitten from Rockville, Maryland was ordered to pay $850,000 to David N. Cantalupo after operating on the man’s eye and leaving him with permanent eye damage.

Mr. Cantalupo alleged that Dr. Whitten knew about his unusually thin corneas prior to LASIK surgery but did not inform Cantalupo of the risk involved in LASIK with thin corneas.

Dr. Whitten is known for performing laser eye surgery on pro golfer, Tiger Woods.

Hospital Accused of Reckless Disregard Following Man’s Death

An Arizona woman is suing the emergency room of St. Mary’s Hospital in Tucson, Arizona following the death of her husband. The suit claims “reckless disregard” by hospital staff led to the death of her 39-year-old husband. The hospital is denying any wrongdoing.

According to the claim, Robert Sweitzer went to the emergency room of St. Mary’s with symptoms of coughing, loss of energy and severe back pain. The ER was very crowded at the time due to an outbreak of the flu.

Rachel Sweitzer says her husband was assessed at 7:00 p.m. but was never re-assessed over the next eight hours. A report from the CDC states that Sweitzer died of necrotizing pneumonia, which is caused by Staphylococcus aureus.

The investigation is ongoing.
