ER Doc Blamed for Patient's Brain Damage and Paralysis

A Florida man was recently awarded $12 million by a jury that blamed two emergency room doctors for ignoring a brain infection that left him brain damaged and paralyzed. Joey Crume, 43, went to the emergency room at Mission Viejo Hospital in September 2004 with what he thought was a very bad headache. A CT scan showed that Crume had a brain infection that forced his brain to crush itself against his skull. Crume had worked at a nuclear power plant testing radiation levels.

A radiologist who testified on behalf of Crume said he could not understand how someone in Crume's condition could even be alive. The radiologist discussed the CT scan results with the ER doctor, Dr. Andrew Lawson, but Crume was given some pain pills and was sent home. Five days later, Crume's brother found him in a coma; Crume had suffered two strokes resulting in permanent paralysis on the left side and brain damage.

The jury decided that while both doctors were negligent in this case, Dr. Lawson was to blame because he sent Crume home even though the radiologist had made him aware of the CT scan results. Crume, who now requires 24-hour care, was awarded a total of $12 million; his wife, Judy, has had to quit her job to take care of her husband.

Couple Awarded 16 Million After Baby Dies During Botched Delivery

A San Diego couple was awarded $16 million by a jury after their infant son died due to medical malpractice. Teresa Bailey was admitted to the hospital for an induced delivery due to concerns about the health of her baby. Ms. Bailey received very little medication while she was in the hospital awaiting childbirth. During the delivery of her son, the infant got trapped in the birth canal and the umbilical cord was wrapped around his neck.

Following the infant’s death, the hospital’s pathologist lied to the mother and concealed the cause of death in the autopsy’s report. The pathologist said the infant died of lung disease.

Dog Mauling Kills Pennsylvania Girl

An eight-year-old Pennsylvania girl died Monday, January 19 after being mauled by a dog that was on the property of a residence in Hanover Township. The girl, Brianna Nicole Shanor, was staying at the residence on Sutherlin Road, which borders West Virginia, and had been there since the beginning of January. The owner of the residence is William J. Renda.

According to police, the girl and Renda were outside around 7:00 p.m., and the girl told Renda she was going back inside because she was cold. She apparently went near one of the dogs on the property, a 100-pound mixed breed, that was chained up outside near an old camping trailer that the dogs used as a shelter. The chain was about 20 feet in length. The girl was bitten several times in different places on her body; one of the bites was on her neck. She was pronounced dead at The Medical Center, Beaver. Unfortunately, there were no witnesses to this dog attack.

Toddler Killed by Neighbor’s Rottweiler

In Fort Worth, Texas recently, a three-year-old girl died after being attacked by her neighbor’s Rottweiler. According to police, the dog attacked the little girl after she climbed through a hole in the fence of her own backyard and then crawled into the animal’s enclosed space.

The dog’s owner has turned the dog over to the proper authorities and is fully cooperating with police. The dog’s vaccinations are allegedly not current; the dog may be euthanized according to the city’s Animal Care and Control Division.

Snack Recall Due to Peanut Butter Contamination

The company that manufacturers Little Debbie snack cakes announced a recall of peanut butter crackers this past Sunday because of a potential link to a deadly salmonella outbreak. This voluntary recall came after the government warned consumers to avoid eating cookies, cakes, ice cream and other foods with peanut butter until more is learned about the peanut butter contamination.

The Peanut Corp. of America expanded its recall to include all peanut butter and peanut paste products produced at its Georgia plant since July 1, 2007.

OSU Pays 1.8 Million in Malpractice Case

Ohio State University will pay almost two million dollars to settle a medical malpractice lawsuit after a patient died following two surgeries nine years ago. Stephen Fortuna, 42, died after surgeries intended to correct gastric reflux disease (GERD). He had surgery in May 1999 and then again three days later.

In the complaint his wife, Vicki Fortuna, claims that the hospital and staff were negligence and failed to inform her husband of the risks associated with the surgery, and he was not advised of alternative treatments, according to his wife.

Colorado ATV Death

A thirty-year-old Aurora, Colorado man died after an all-terrain vehicle (ATV) accident in Adams County Sunday. The man was pronounced dead at the scene of the accident, in a pasture on Converse Road in Adams County, Colorado. The State Patrol suspect alcohol or drugs may have played a party in this accident. Shawn Hall was riding on private property and was not wearing a helmet when the crash occurred.

Alzheimer’s Drugs May do More Harm than Good

Some of the anti-psychotic drugs used to treat Alzheimer’s patients such as Risperdal, Thorazine and Stelazine, may double their risk of dying within a few years, studies show. The research was published recently in the medical journal, Lancet Neurology. Other side effects to these drugs include respiratory problems and stroke.

Alzheimer’s is the most common cause of dementia and causes symptoms of delusions, hallucinations, and aggression. After two years, 46% of Alzheimer's patients taking the anti-psychotics were alive, versus 71% of those not on the drugs. After three years, only 30% of patients on the drugs were alive, versus 59 percent of those not taking drugs.

In the United States, guidelines advise doctors to only prescribe these anti-psychotic drugs for short periods of time; however, in many nursing homes across the country, as many as 60% of all patients with dementia are routinely given the drugs for a year or two.

Two-year-old Dies in ATV Accident

In a tragic ATV accident, a father just may be responsible for the death of his son. Two-year-old Jackson Moore was riding on an all-terrain vehicle that his father, Nicholas Moore, 29, was driving through a wooded area in Missouri this past weekend. The boy was in his father’s lap and the vehicle was traveling at a speed slow enough for another relative to walk beside the ATV. The father, while driving, looked at his cell phone to read a text message, at which time his son hit the throttle propelling the ATV into a tree and forcing the father off the vehicle. The child was not wearing a helmet. The relative, a paramedic, performed CPR, but the boy was later pronounced dead at a nearby hospital.

When questioned by police, the father told them the 2-year-old had fired a .22 caliber rifle earlier that day. But the father insists he was careful with the gun and the ATV.

Helicopter Crash Kills Eight in Louisiana

In a tragic helicopter crash on Sunday, January 4, 2009, eight people died and one is in critical condition after the helicopter went down in a marshy area in the lower southwest portion of Terrebonne Parish in Louisiana. The chopper was a PHI, Inc. helicopter that had just taken off from the PHI operating base and was headed to an offshore oil platform when it crashed.

A distress signal from the chopper was picked up by The United States Air Force Rescue Coordination Center in Virginia, which then alerted the Coast Guard station in New Orleans. Then the Coast Guard launched a rescue helicopter from New Orleans to the scene of the accident in Terrebonne Parish. Early reports indicate the chopper crashed just seven minutes after takeoff.

PHI, Inc. is a helicopter services company that provides transportation to offshore oil and gas, onshore mining, and medical and technical service industries. In June of 2008, four people died in a crash in Texas. Three crew members and a patient they were transporting died after the chopper crashed near Huntsville.
