Birth Injuries and Medical Malpractice

A birth injury can be prevented with good obstetrical and neonatal care. A birth injury results from something that went wrong during labor and delivery. Prolonged or difficult labor (dystocia) can lead to a birth injury. Dystocia causes oxygen deprivation to the fetus. New Information on Butte, Montana Plane Crash

New details have come to light in the horrific single-engine turboprop plane crash in Butte, Montana on Sunday. All 14 people on board died in the fiery crash; many on board were children. The focus of what caused the crash has now shifted to ice on the wings, but the first thought was that the plane went down due to being overloaded with too many passengers. The plane was designed to carry only 10 passengers. The plane nose dived into a cemetery just 500 feet short of the airport’s runway. Because cockpit voice recorders and flight data recorders are not required in smaller aircraft, finding the cause of the crash will be much more difficult than it would be with a larger plane.

While the plane was descending to land at the Bert Mooney Airport, it passed through a layer of air that was conducive to icing because of the below freezing temperatures and 100% humidity. This scenario is being compared to a similar icing condition that existed when the Continental Airlines twin-engine turboprop went down in Buffalo last month, killing fifty people.

Head Injury While Skiing May Have Caused Actress' Death

British actress, Natasha Richardson, who is the daughter of Vanessa Redgrave, the wife of actor Liam Neeson, and the sister of actress Joely Richardson has died of an apparent head injury following a ski fall on a beginner's slope in Quebec.

Ms. Richardson was not wearing a helmet, and she seemed fine immediately after the fall. The 45-year-old beginner skier said that she didn't feel well about an hour after the fall and complained of a headache.

She was hospitalized in Montreal and died there Wednesday evening.

Traumatic brain injuries often show no early symptoms, and for that very reason, many people who hit their head or fall or receive a blow to the head often do not seek medical attention right away or ever. LASIK SurgeryCauses Permanent Damage

A West Virginia man was recently awarded over $1 million dollars by a jury due to botched eye surgery. Dr. Mark Whitten from Rockville, Maryland was ordered to pay $850,000 to David N. Cantalupo after operating on the man’s eye and leaving him with permanent eye damage.

Mr. Cantalupo alleged that Dr. Whitten knew about his unusually thin corneas prior to LASIK surgery but did not inform Cantalupo of the risk involved in LASIK with thin corneas.

Dr. Whitten is known for performing laser eye surgery on pro golfer, Tiger Woods.

Supreme Court Upholds Decision Against Pre-Emption

The United States Supreme Court, in a bold action, upheld a $6.7 million jury award to a woman who lost her arm because of a botched injection of the anti-nausea drug, Phenergan, that caused the nicking of an artery; gangrene then set in. The woman eventually lost her arm.

Wyeth, the manufacturer of Phenergan, claimed that because the FDA approved the anti-nausea drug, even for IV use, it was exempt from lawsuits. This is known as "pre-emption," but the Supreme Court ruled against Wyeth by upholding the decision to award the woman, a former musician, several million dollars following the loss of one of her arms.

A Vermont jury had agreed with the woman's lawyer that Wyeth failed to provide a strong and clear warning about the risks of injecting Phenergan directly into a vein (an IV push). Wyeth argued that once a drug’s warning label gets FDA approval, the label cannot be changed without further FDA approval and consumers cannot file law suits claiming they have been harmed.

WV Motorcyclists Killed; Road Hazard Proves Deadly

A man who was injured when the motorcycle he was riding on hit a drain created by a local road paving company is suing that company. The lawsuit was filed in a West Virginia Circuit Court against Mountaineer Contractors, Inc. According to the suit, the contracting company had paved several roads in Morgantown, West Virginia, and as part of the paving project, certain drain openings were placed in the pavement "at significant depth below the surface of the roadway, creating a hazard to persons using the roadway," according to the lawsuit.

Daniel Slonaker was riding his motorcycle in July 2005 when his front wheel entered the hole surrounding the drain left by the paving company. Slonaker was thrown over the handlebars of the bike and hit his head on the pavement. He sustained several injuries, including a closed head injury, which resulted in loss of memory and mental impairment. The suit alleges it is the paving company's fault because the hole and the drain were not marked.
