Zicam Lawsuits Settled in 2006, More Filed
Zicam, a nasal cold medication, has been involved in a rash of lawsuits from users claiming the remedy caused anosmia, or loss of smell, after they used it to alleviate cold symptoms. Three of the Zicam remedies have been noted by the FDA as potentially hazardous, and Matrixx, the producer of Zicam products, has recalled their Cold Remedy Swabs, Cold Remedy Swabs, Kids' Size, and Cold Remedy Nasal Gel.
Matrixx paid $12 million to over 300 people in 2006 for a class action lawsuit linking Zicam to anosmia, but despite this settlement, the product was not removed from shelves, and Matrixx has insisted Zicam is safe for use. Plaintiffs are currently seeking compensation for as much as $75,000 for loss of smell linked to Zicam.
Although Zicam is not the only commercial product to experience a number of lawsuits regarding faulty information, injury or wrongful death, it is currently receiving attention from the FDA. Individuals who have experienced a loss of the ability to smell after using the product may be eligible for reimbursement from Matrixx, and should seek legal counsel regarding their situation.
If you are in the Columbus, Ohio area and have experienced injury or loss of smell due to a product failure, please contact Robert W. Kerpsack, Co., L.P.A. today for a free case review.

Jury Awards $60 Million in Medical Malpractice
Allison Hugh of the Bronx, New York, brought a lawsuit against her plastic surgeon regarding a botched thigh lift and was subsequently awarded $60 Million. The plastic surgeon, Ferdinand A. Ofodile, M.D., was found by the jury to have failed to warn Ms. Hugh of the possible complications associated with the procedure, and of deviating from appropriate medical practices.
Every year, thousands of women and men have cosmetic procedures to regain the look of their youth, or to achieve the appearance they have always wanted. For most of these men and women, the result is what they wanted. But for many others, the affects of their procedure left them scarred, either physically or emotionally, often times as the result of medical malpractice on the doctor’s part.
In cases like Ms. Hugh's botched surgery, the result can be emotionally and physically traumatic, and could dictate reimbursement for that pain and trauma. In her case, the jury awarded her $10 million for past pain and suffering, and $50 more for future suffering.
If you have suffered from a doctor's error or failure to make you aware of certain risks associated with treatment, please contact Robert W. Kerpsack, Co., L.P.A. in Columbus, Ohio, attorney experienced in medical malpractice suits, and let us help you regain the peace you lost.

Blue Dye Treatment for Spinal Cord Injuries
Whenever a person suffers from a serious spinal cord injury, there is much uncertainty and fear that accompanies questions, like whether they will be able to function normally. Perhaps surprisingly, many long-term injuries resulting from spinal cord damage are not directly caused by the accident but are referred to as secondary injuries, or injuries that result from movement or strain after the initial injury.
A new study supported by the New York State Spinal Cord Injury Program shows early indications that these secondary injuries may be treated and greatly reduced through the use of blue dye. The dye, called Brilliant Blue G, or BBG, when injected into lab rats with spinal injuries inhibited the progression of injuries. Rats who received the injections were able to walk within a few days, though they limped, in contrast with rats that did not receive injections of BBG and did not recover the ability to walk. The only noted side affect was the dye's tendency to turn soft pink tissue blue.
Although this is a promising study, BBG is not ready to be used in clinical trials. There is extensive testing yet to be done before it can be offered for use in treating human spinal cord injuries.
If you or someone you love have experienced a spinal cord injury that was due to the negligence of another, or if you're struggling to receive the appropriate insurance reimbursement, please contact Robert W. Kerpsack, Co., L.P.A., with offices in Columbus, Ohio, and let us help you start moving forward again.

Sturgis Rally Plays Host to Increased Motorcycle Accidents
Almost every year the Sturgis Motorcycle Rally sees an increase in motorcycle accidents around the first week of August, when thousands of motorcyclists visit Sturgis, North Dakota for the rally. Fortunately, most of these accidents don't result in wrongful death, but many of them do result in serious injuries.
Many of the motorcyclists come from Ohio, and many more travel through Ohio on their way to the rally. Drivers and riders both should be exercising increased caution during the end of July and the beginning of August when more motorcyclists are on the road. Most motorcyclists, aware of their increased risk in comparison to a driver in a car or truck, drive more carefully. In many cases, the motorcyclist is not at fault, other drivers citing their failure to see the motorcyclist or poor driving conditions as the cause for the accident. In these instances, you may have the right to financial compensation for your injuries.
In accidents where permanent debilitating injury or death the death of a loved one results from a motorcycle accident, you should contact legal representation immediately to find out your rights. Don't let a painful accident or loss of a loved one debilitate you financially for life.
If you have been injured or lost a loved one as the result of an accident, contact experienced motorcycle accident attorney Robert W. Kerpsack Co., L.P.A., located in Columbus, Ohio, and get started on the road to recovery today.

Ohio Bus Driver on Cell Phone during Pedestrian Accident
In March of this year, an Ohio bus driver was driving her bus and talking on her cell phone when she hit and killed a pedestrian. Bus drivers in Ohio are strictly forbidden from talking on cell phones while they are driving city vehicles.
Shockingly, the bus driver is no stranger to pedestrian accidents because she was fired in 2006 after hitting a pedestrian and causing minor injuries. The victim in this more serious pedestrian accident wasn't so lucky because he suffered a wrongful death at the scene.
Pedestrian accidents like this are difficult to handle, and the surviving family members deserve to recover compensation from the negligent bus driver who hit their loved one, and possibly the city for employing a person who is known to have caused accidents in the past. An experienced Ohio personal injury attorney can help family members by filing their lawsuit for them while they deal with the loss of their loved one.
If you or someone in your family has been injured or even killed in a pedestrian accident, you could recover compensation for their injuries. Please contact the experienced Columbus, Ohio pedestrian accident lawyer, Robert W. Kerpsack Co., L.P.A.

Local Driver Dies after Severe Truck Accident
While a full accident investigation is still underway to determine the actual cause of the truck accident, one man is now dead after crossing paths with a semi-truck. The accident demolished the man's car and he was pronounced dead at the scene.
According to initial reports from police officers at the scene the man was driving a small passenger vehicle and was attempting to merge onto a highway. While merging, the man failed to see the massive truck bearing down on him and simply pulled out in front. At the moment, alcohol is not suspected as a factor of the accident, but the investigation is still underway.
An experienced auto accident attorney, like Robert W. Kerpsack, can help grieving families during times like this. Your attorney will review accident reports and witness accounts of the accident to find out what caused the motor vehicle accident. In this case, the truck driver may have had enough time to avoid the accident, but driver fatigue or other circumstances may have prevented them from acting correctly.
If you or anyone in your family has been injured in an auto or truck accident, the best thing you can do is contact Robert W. Kerpsack Co., L.P.A., experienced Columbus, Ohio personal injury attorney.
