Ohio Personal Injury Lawyer
We represented a police officer who was injured when an impaired driver attempted to flee during a routine traffic stop. The driver was arrested and charged with felonious assault. The police officer pursued a workers' compensation claim. However, the insurance company covering the vehicle that struck the officer denied liability coverage for the occurrence, arguing that the driver acted intentionally and criminally. At the suggestion of family members, the police officer hired Robert W. Kerpsack Co., L.P.A. We filed suit against the driver and the vehicle owner, who had provided the driver with access to the vehicle. Shortly after the lawsuit was filed, the insurance company reconsidered its position, and the police officer's personal injury claim was settled. This was important to the officer and his family because his Worker's Compensation benefits did not provide compensation for the permanent pain and suffering that he will endure as a result of the accident. Workplace injuries are all too common, and can be complicated and overwhelming to the victim. Often, these injuries are covered by Workers' Compensation benefits, mandated by the state. However, depending on the nature of the accident and the type and extent of injuries, there may be additional avenues of recourse for injured parties. For example, if an employee is injured on a worksite due to faulty equipment, negligence, or other actions on the part of a third party, the injured person may be able to sue the manufacturer, the premises management, or someone else who can be shown to be responsible. Particularly in the case of long-term and debilitating injuries, these additional funds may be necessary to ensure the long-term well being of the injured worker and his or her family. At Robert W. Kerpsack Co., L.P.A., we believe that, when hard working are injured on the job they deserve compensation for their injuries, and they deserve to be able to maintain the quality of life that they've worked so hard to establish. If you or a loved one has been injured on the job, call us today. We'll schedule your free, personal consultation, and help you and your family get started on the long road to recovery. |
